Vino Veritas

Terms and conditions of sale

HERNANDEZ SASU – Vino Veritas · version in force on 8 October 2026

Article 1 – Purpose and scope

These general terms and conditions of sale (the “Terms and conditions of sale”) govern all sales concluded on the website vino-veritas.fr between HERNANDEZ SASU (the “Seller”) and any natural person of legal age acting as a consumer (the “Customer”). They apply to wines, beers, spirits, fine food products and gift cards, as well as to the workshops and tastings offered for sale on the website.

The Customer declares that they have read the Terms and conditions of sale and accept them without reservation before placing an order. The applicable terms are those in force on the date of the order. They can be saved and printed at any time from this page.

Article 3 – Sale of alcoholic beverages and legal age

The sale of alcoholic beverages to minors under 18 is prohibited (Article L. 3342-1 of the Public Health Code). By placing an order, the Customer certifies that they are at least 18 years old; this certification is mandatory to validate any order. The Seller reserves the right to request proof of age and to cancel, at no cost to the Customer, any order for which the Customer’s or recipient’s legal age cannot be established. The carrier or pick-up point may also require proof of identity when handing over the parcel.

Excessive drinking is harmful to your health. Please drink responsibly.

Article 4 – Products

The essential characteristics of the products (appellation, producer, cuvée, colour, vintage, volume) are shown on each product page. Photographs are for illustration only: the label may vary slightly from one vintage or print run to another.

Products are offered while stocks last. If an ordered product is no longer available, or if the vintage shown is sold out, the Seller informs the Customer as soon as possible. The Customer may then accept another vintage or an equivalent product offered to them, or obtain a refund of the sums paid for that product no later than 14 days after payment.

Wines are living products. A deposit, tartrate crystals or a slight change in colour or taste over time are natural, particularly in organic, biodynamic and natural wines, and do not constitute a defect.

Article 5 – Price

Prices are shown in euros, including all taxes (TTC), excluding delivery costs. Delivery costs are shown before the order is placed and are set out in article 8. The Seller may change its prices at any time; products are invoiced at the price displayed when the order is placed.

Article 6 – Order

To order, the Customer adds the products to their basket, chooses the delivery method, enters their details, certifies that they are of legal age, accepts these Terms and conditions of sale and then places the order with an obligation to pay. Before confirming, the Customer can check the details of their order and its total price and correct any errors.

The contract is concluded upon receipt of payment or, for payments by bank transfer or cheque, upon confirmation of the order. The Seller sends the Customer a confirmation email summarising the order. The Seller reserves the right to refuse or cancel an order in the event of a previous payment dispute, a quantity that is abnormal for personal use or serious doubt as to whether the Customer is of legal age.

Article 7 – Payment

The price is payable when the order is placed, using one of the methods offered on the site:

  • Bank card (and, depending on the device, Apple Pay or Google Pay), via a secure payment provider. Bank details are neither passed on to nor stored by the Seller.
  • Bank transfer: the bank details are provided in the confirmation email. The order is prepared once the transfer has been received. If the transfer is not received within 3 days, the order is cancelled.
  • Cheque made payable to HERNANDEZ SASU, sent to the registered office. The order is prepared once the cheque has been cashed. If the cheque is not received within 5 days, the order is cancelled.

The products remain the property of the Seller until the price has been paid in full.

Article 8 – Delivery

Delivery areas and methods. Deliveries are made to the following addresses:

  • Austria and Poland: to a Chronopost pick-up point (Shop2Shop).

No delivery is offered to other destinations.

Lead times. Orders are prepared within 3 working days of receipt of payment. Indicative transit times are 2 to 4 working days in France and 3 to 6 working days to other countries. Delivery by bike within the Lyon metropolitan area takes place in the time slot agreed with the Customer. In all cases, delivery takes place no later than 30 days after the contract is concluded.

Collection from a pick-up point. The Customer is notified by the carrier when their parcel arrives. They must collect it within the period indicated by the carrier, bringing proof of identity. A parcel that is not collected is returned to the Seller; a new shipment is then charged to the Customer at the current rate.

Receipt. The Customer checks the condition of the parcel when it is handed over. In the event of a damaged parcel, a broken bottle or a missing product, the Customer is asked to make specific reservations with the carrier or the pick-up point, and to inform the Seller as soon as possible, with photos if possible, at contact@vino-veritas.fr. The Seller will then replace or refund the products concerned. The risk of loss or damage passes to the Customer when they take physical possession of the products.

Delay. If the delivery date or deadline is exceeded, the Customer may, after unsuccessfully instructing the Seller to make the delivery within a reasonable additional period, terminate the contract in writing; they are then refunded within 14 days at the latest (articles L. 216-6 and L. 216-7 of the French Consumer Code).

Deliveries outside France. Any excise duties and taxes due in the country of destination are paid by the Seller; no additional amount is claimed from the Customer on delivery.

Article 9 – Right of withdrawal

In accordance with Articles L. 221-18 et seq. of the Consumer Code, the Customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to give reasons for their decision. If several products ordered are delivered separately, the period runs from receipt of the last product.

Exercising the right. The Customer informs the Seller of their decision by an unambiguous statement, by email to contact@vino-veritas.fr or by post to the registered office, using the form in the appendix if they wish. They then return the products, complete and in their original condition (unopened bottles, capsules and corks intact), without undue delay and no later than 14 days after communicating their decision, to the address: HERNANDEZ SASU – Vino Veritas, 4 rue de la Cachette, 69250 Fleurieu-sur-Saône. Return costs are borne by the Customer. Bottles must be packed with care; the Customer is liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature and characteristics.

Refund. The Seller refunds all sums paid, including the initial delivery costs (up to the cost of the cheapest delivery method offered), no later than 14 days after being informed of the Customer’s decision. The Seller may defer the refund until the products have been recovered or until the Customer has provided proof of having sent them. The refund is made using the same means of payment as that used for the order, unless the Customer agrees otherwise.

Exceptions. In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for:

  • products liable to deteriorate or expire rapidly, in particular oysters and other fresh produce;
  • products unsealed after delivery which cannot be returned for reasons of hygiene or health protection, in particular opened bottles;
  • alcoholic beverages whose delivery is deferred beyond 30 days and whose agreed price depends on market fluctuations (en primeur sales);
  • workshops, tastings and other leisure services provided on a specific date.

Article 10 – Legal guarantees

The Seller is bound by the legal guarantee of conformity (articles L. 217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code).

Legal guarantee of conformity. The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, they are only required to establish the existence of the lack of conformity and not the date on which it appeared.

The legal guarantee of conformity requires the seller to provide, where applicable, all updates necessary to keep the goods in conformity.

The consumer may obtain the repair or replacement of the goods, free of charge and without major inconvenience, within 30 days of their request. If bringing the goods into conformity is impossible, refused or not carried out within this period, or if the defect persists, they may obtain a price reduction while keeping the goods, or terminate the contract by returning the goods in exchange for a full refund. The contract cannot be terminated if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining warranty period until the repaired goods are delivered.

These rights result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code. A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the Consumer Code).

Guarantee against hidden defects. The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles them to a price reduction if the goods are kept, or to a full refund upon return of the goods.

For any claim under these guarantees, in particular for a corked or spoiled bottle, the Customer contacts customer service, giving their order number and keeping the bottle.

Article 11 – Workshops and tastings

Workshops and tastings take place on the date, at the time and at the venue shown on their page. Bookings are confirmed by email after payment. Participants must be of legal age; proof of identity may be requested.

A Customer who cannot attend may ask to transfer to another session, subject to availability, by notifying the Seller at least 48 hours before the start of the workshop. They may also give their place to another person of legal age. Failure to attend without notice or a later cancellation gives no entitlement to a refund or a transfer.

The Seller may cancel a workshop if there are not enough participants or if it is unable to hold it. The Customer is informed as soon as possible and may choose between a postponement and a full refund of their booking.

Article 12 – Gift cards

Gift cards are valid for 6 months from purchase, across the whole shop. They cannot be refunded, exchanged for cash or extended beyond their expiry date. A printed card can be provided on request.

Article 13 – Fresh produce

Fresh produce (oysters and other seasonal products) is available to order, with an order deadline and a delivery or collection date shown on its page. It must be collected or received on the scheduled date and stored according to the instructions provided.

Article 14 – Customer service and complaints

For any question or complaint, the Customer may contact the Seller by email at contact@vino-veritas.fr, by telephone on 07 69 66 18 47, or by post to the registered office.

Article 15 – Consumer mediation

In the event of a problem, the Customer first sends a written complaint to customer service (article 14). If no amicable solution is found, and in accordance with articles L. 611-1 et seq. of the French Consumer Code, they may refer the matter free of charge to the consumer mediator to which the Seller belongs:

CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris
Website: www.cm2c.net – email: secretariat@cm2c.net

The matter may be referred to the mediator no later than one year after the written complaint sent to the Seller.

Article 16 – Personal data

The personal data collected when an order is placed are processed by HERNANDEZ SASU to manage orders, delivery, customer service and accounting obligations. They are passed on only to the service providers needed to fulfil the order (payment provider, carriers) and are never sold. The Customer has the rights provided for by the GDPR, detailed in the legal notice, which they can exercise at contact@vino-veritas.fr.

Article 17 – Applicable law and disputes

These Terms and conditions of sale are governed by French law. In the event of a dispute, the Customer may, at their choice, refer the matter to the court for the place where they were living at the time the contract was concluded or the harmful event occurred, or to any other court with jurisdiction under the law.
